CAROHAV HAVANESE
SALES CONTRACT:
A deposit of $500.00 will be used against the total purchase price of above referenced dog. All deposits are non-refundable.
Final payment for above dog shall be made before delivery of dog unless otherwise stated by the Seller (see additional comments).
Upon receipt of full purchase price, Seller will provide the Buyer with a registration certificate from the American Kennel
Club hereinafter referred to as "AKC" (within six months of full payment) with the information as specified above (See Companion
for further requirements on receiving AKC Registration).
Above dog is being sold as a Companion Dog and is to be spayed/neutered. This dog is never to be bred.
The Seller does hereby warrant that the above dog is in good health. However, within five days of purchase, the Seller
is provided with a written statement by a licensed Veterinarian stating that the above mentioned dog was/is suffering from
infirmity or disease as of the purchase date, said statement must include; Buyer/s Name, Address, date dog was examined, breed
and age of dog, that the Veterinarian examined the dog, and said dog had/has disease/illness which causes it to be unfit for
purchase or resulted in its death (in the event of death a Certified Copy of Veterinarian’s autopsy will be provided to the Seller), and exact finding of said
examination, the Seller may replace the puppy (upon return of the above dog, shipping to be paid by Buyer).
If the Seller determines that a puppy will not be available within a reasonable amount of time, not to exceed three years,
the Seller at her sole discretion may return the original purchase price. Seller’s liability will be limited to the refund of purchase price or replacement only within this time
frame. It is also understood that any medical expense, including routine health checkup and care are the Buyer’s obligation.
Treatment Of The Dog:
This dog is to be kept as a house pet only. Extensive time in outside areas, garage, or tied up outside is not allowed.
The dog is to kept in the Buyer's living quarters.
It is highly recommended that a professional trainer be consulted to train the dog and Buyer in the proper handling of
the dog. Also, the dog should attend a "puppy class" to provide adequate socialization training.
This dog requires regular bathing and brushing, as well as nail trims and dental care. If buyer is unable to perform these
tasks, the care will be given by a qualified groomer.
This dog will never be allowed to run off-lead except in a safely enclosed area.
The Buyer shall provide the dog with necessary veterinary care upon sickness, disease, or injury, and shall take it to
a veterinarian at least once a year for an annual health examination. Heart worm prevention should be given on a monthly basis.
Companion Dogs:
If the parties to said sale or disposition have agreed in writing that the dog will be transferred into the name of the
new owner and the new owner shall be provided with the Certificate of Registration only when certain specific obligations
have been fulfilled by the new owner, then the seller shall not be obligated to transfer the dog, or deliver the Certificate
to the new owner until the purchaser(s) has fulfilled all such obligations. The sales transaction will be deemed complete
upon proof of the spay/neuter procedure and the AKC records will reflect the date of the breeder receiving the spay/neuter
certificate, as the date of sale. Proof of spay/neuter can be mailed, or scanned and e-mailed to the Seller(s). It is understood
that the dog must be spayed/neutered by the age of twelve (12) months. Should the Buyer wish to delay sterilization of the
dog it must be agreed to in writing by the Seller. Failure of the Buyer to comply with this requirement will result in the
Buyer being liable for $1,500.00 in fines in addition to any legal and court costs incurred by the Seller with court proceedings
to commence in the State and county in which the Seller resides. These costs become immediately due and payable should the
dog attain the age of thirteen (13) months and remain intact.
IMPORTANT NOTE:
Individual dogs must be registered within one year of the issue date of the individual registration application or additional
fees will accrue from the AKC. Breeder will not refund any monies or pay any fines that may be levied by AKC.
Replacement policy:
This puppy may be replaced only if within 2 years of said dog’s birth, if it is determined by two unassociated Veterinarians and a professional breeder of Sellers
choice, that due to some inherited health problem, the puppy cannot live a normal, healthy life and the puppy either expires
as a result or must be euthanized. If the Seller determines that a puppy will not be available within a reasonable amount
of time, not to exceed three years, the Seller at her sole discretion may return the original purchase price. The Buyer understands
that the Seller has limited information and control regarding the future temperament, habits, and appearance of the dog, and
hence does not warrant such.
RIGHT OF FIRST REFUSAL:
If for any reason the Buyer cannot or chooses not to keep this dog whether the dog is for companion or show, the SELLER
HAS THE RIGHT OF FIRST REFUSAL FOR THE LIFETIME OF THE DOG.
Seller requires that the name "Carohav" be used as the beginning of registered name.
Seller asks to be kept informed on dog’s progress and health and will always be available to answer questions, give guidance, etc.
Seller requires that any change of address, phone number, e-mail, etc. be provided within 14 days of the effective date
of change.
THIS DOG IS SOLD TO BE A HOUSE DOG. Its sole joy in life is to give and receive love. It should never be delegated to live
outside or in a kennel. Buyer will provide this dog with quality dog food, proper veterinary care, a safe fenced yard and
proper daily exercise.
Under the terms of this contract, the Seller has the right to investigate the care of the Havanese. If Seller feels that
the Havanese is not getting the proper care and treatment, the Seller has the right to have the Havanese examined by a licensed
Veterinarian agreeable to the Purchaser and the Seller. If the Veterinarian finds the Havanese a victim of abuse or ill treatment,
the Seller has the right to take full POSSESSION of the Havanese, and then all guarantees with the Purchaser will be null
and void.
By signing this contract you are agreeing you have read it and understand the contract in full. This agreement is made
to insure the well being and protection of the animal. This is a binding contract. Legal action can and will be taken against
the Buyer should the Buyer breech this contract. This action will take place in the state the seller resides in and Buyer
will assume any and all attorney’s
costs and court expenses. If any part of this agreement is breached, the seller is released from any further obligations hereunder.
